Rush Fee:
Any orders booked with less than 10 (ten) days notice will have a 20% rush fee applied to the total order. This fee helps us ensure we can accommodate your last-minute requests without compromising on quality or service.
Allergies:
Cookies by Qui will not be held responsible for any allergy related issues. Unless it is specified otherwise on your order, all products may contain or come into contact with dairy, wheat, nuts, soy and other allergens. It is the client’s responsibility to inform their guests of any risks.
Collection:
Cookies are to be collected at a mutually agreed upon time from the St Albans Park address given. If you have placed an order and I have tried to contact you both by email and phone (and or text message) and have not received correspondence within 24 hours of non collection, your cookies will be forfeited and no refunds will be given.
Digital Drawing Designs Terms and Conditions:
All digital drawings (mock-ups) are charged at $80/ hour. This includes 1 (ONE) revision per design. Any more design changes will incur a fee. All digital drawing designs must be finalised within 7 days of collection. If the designs are not finalised within this timeframe, it will be at my discretion to proceed with creating the designs based on the initial brief provided. Any changes or adjustments requested after the 7-day period may not be accommodated, and additional fees (including rush fee) may apply.
Covid Terms & Conditions:
I retain the right to cancel the booking due to circumstances beyond my control, such as ill health/family emergency/isolation, during which you will have 3 options to choose from. 1. I will refund any money paid in full. 2. I will attempt to organise another local cookie decorator to provide a replacement, or 3. I can move it to another date. Due to the current unpredictability, if your party or event gets canceled due to restrictions, illness, etc. no refunds will be given. However any money paid will be put towards a credit for a future order. Please note there may be an increase or decrease in price if you change designs. If this occurs, you will be liable for any money owing. If your cookies have already been made and decorated when a new restriction is announced or you inform me that you (or someone close to you) is ill, you will be sent home with instructions on how to store the cookies long term. I am not liable for any damage to the cookies if you do not follow storage instructions given and no refunds will be given at any point in time. By paying for your order, you agree to these terms & conditions. Thank you for your understanding as we navigate the current climate.
Deposit, Cancellation and Refund Policy:
Each quote is valid for 48 hours from the date of issue.
Upon basic design constructs of your cookies being finalised and proceeding with the order full payment will be required. Your booking is not considered confirmed until the payment has been received. Our method of payment is via direct deposit. Failure to make payments by the due date WILL result in your order being automatically cancelled without warning; please contact me ASAP to discuss any problems/ possible late payment issues.
Non Guarantee:
Cookies by Qui cannot be held responsible for any damage to the cookies once they are delivered, shipped and/or collected and in the care of a client or the venue. Where a client elects to self-transport, we are not responsible for any damage caused during transportation.
Shipping Terms & Conditions:
No refunds or exchanges will be given in case of late delivery or broken/damaged cookies.
Photo Usage:
Cookies by Qui reserves the right to use any photos we take of your creation for media related activities such as publishing on our website, social media or advertising.
Edible Images & Colour Variations of Hand Piped Cookies:
1. Edible Ink and Colour Variations: We use edible inks to print logos and designs on our cookies. While we make every effort to replicate the colours of the logos accurately, please be aware that due to the nature of edible inks and variations in the printing process, the colors of the printed logos may not be exact replicas of the original logos or designs.
2. Image Representation: The images of the printed logo cookies displayed on our website or promotional materials are for illustrative purposes only. The actual appearance of the printed logos may vary slightly in colour and design.
3. Acceptable Color Deviations: You agree to accept reasonable colour deviations in the printed logos, or hand piped cookies and such deviations shall not be considered as defects in the product. Minor variations in color may occur, and these shall not be eligible for refunds or exchanges.
4. Customisation Approval: Before we proceed with printing your logos on the cookies, we will provide you with a digital proof for your approval. It is your responsibility to carefully review the proof, including the colours, design, and placement of the logo. Once you provide your approval, we will proceed with the printing process based on the approved design.
5. Customer's Responsibilities: As the Customer, you are solely responsible for ensuring that the logos or designs provided to us for printing are accurate and comply with all applicable laws and regulations. We shall not be held liable for any copyright or trademark infringement arising from the use of logos or designs provided by you.
6. Returns and Refunds: Due to the personalised and edible nature of the printed logo cookies, we do not accept returns or offer refunds based on slight color variations from the original logo or design. If there is a significant defect in the product unrelated to the colour, please refer to our standard return and refund policy.
7. Limitation of Liability: In no event shall we be liable for any direct, indirect, special, punitive, incidental, or consequential damages arising out of or related to the use of our logo printed cookies, including but not limited to colour variations. Our total liability to you for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the specific order in question.
8. Intellectual Property: You acknowledge and agree that all intellectual property rights in the logos, designs, and any artwork provided by you for printing on the cookies belong to you or your respective licensors. By providing the logos or designs to us, you grant us a limited, non-exclusive, royalty-free license to use and reproduce such logos or designs solely for the purpose of fulfilling your order.
9. Modification of Terms: We reserve the right to modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically for any updates.
10. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Australia. Any dispute arising out of or relating to these Terms or the use of our logo printed cookies shall be subject to the exclusive jurisdiction of the courts located in Australia.
